Terms of Service
These terms cover using KOLA — browsing events, buying tickets, and selling them. Using the site means agreeing to them. We've kept them as short as we can.
Who you're buying from
KOLA is a platform. When you buy a ticket, you are buying from the event organiser, not from KOLA. The organiser sets the price, decides who gets in, runs the door, and is responsible for the event happening as advertised.
We handle the transaction, issue the ticket and take a fee for doing so. Payment is processed by Stripe into the organiser's own account. If an event is cancelled, moved, oversold, or is not what was described, that is a matter between you and the organiser — though we will help, and in the cases described in our Refund Policy we act automatically.
Your account
You need an account to hold tickets. Keep your login details to yourself: anybody with access to your account has access to your tickets, and a QR code is all it takes to get through a door.
You must be old enough to enter into a contract where you live. Individual events may set their own age limits, which are enforced at the door by the organiser, not by us.
If somebody sends you a ticket at an address that has no KOLA account, we create one for that address so the ticket has somewhere to live. You can close it at any time from your account settings.
What a ticket is
A ticket is a revocable licence to attend an event, not property. It admits one person once, at the discretion of the organiser and the venue. Organisers and venues may refuse entry for the reasons they are entitled to refuse it — intoxication, age, behaviour, capacity, or their own published conditions.
Each admission has its own QR code. Screenshots of a ticket you have transferred stop working, because the code changes when the ticket moves.
Fees
KOLA charges a 3% service fee on the ticket price, shown separately at checkout and paid by the buyer. Card processing is charged at cost and also shown separately. Neither is hidden in the ticket price, and the total you approve is the total you pay.
Where sales tax applies it is calculated at checkout based on the event's location and the organiser's tax registration.
Transferring and reselling
You may send a ticket to somebody else through KOLA. Doing so moves the ticket to them and stops your copy working immediately.
Reselling tickets outside KOLA is not allowed. A ticket sold on another platform, or privately, cannot be re-issued to its buyer and may be voided. This exists to protect people from buying screenshots of tickets that don't work.
If you sell on KOLA
Organisers are responsible for their events being real, accurately described, lawfully run, and properly licensed. You must hold the rights and permissions you need for the venue, the performance and the audience you're admitting.
You are the seller of record for your tickets. Funds are paid into your own Stripe account, less KOLA's fee. You are responsible for your own tax obligations, for honouring the refund terms you have set, and for refunding buyers in full if you cancel.
We can remove an event, withhold funds, or close an account where we have reasonable grounds to believe an event is fraudulent, unsafe, unlawful, or that a chargeback risk would otherwise fall on buyers.
Things we don't promise
We work hard to keep KOLA running, but we don't promise it will be available without interruption, or that the door will scan on a venue's wifi. Where a scanner cannot reach the internet, organisers should have a fallback — a printed list is not a failure of your ticket.
Except where the law says otherwise, our liability to you for anything arising out of your use of KOLA is limited to the fees we charged you on the transaction concerned. We are not liable for the event itself: whether it happens, what it's like, or what occurs there.
Nothing here removes rights you have under consumer protection law, which vary by where you live and which we do not attempt to override.
Ending things
You can close your account at any time. If you hold tickets to events that haven't happened yet, closing your account cancels them and returns the seats to sale — you will not be refunded for them, so ask for a refund or pass them on first. We tell you this before you confirm.
We may suspend or close an account that breaches these terms, is being used fraudulently, or is being used to harm other people on the platform.
Law and contact
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
We may update these terms. If a change materially affects you, we'll say so by email rather than quietly changing the date at the top.
